GENERAL TERMS AND CONDITIONS

By purchasing from and using the website www.williamsamsterdam.com, you have agreed to our general terms and conditions. Therefore, please make sure to read and understand these terms while using our website.

These terms and conditions govern your purchases and website use and thereby form a contract between you and WILLIAMS AMSTERDAM (Dutch company registration number 68894988).

 

ORDERING

In case of incorrect pricing on an order, WILLIAMS AMSTERDAM holds the right to cancel the purchase and refund any amount paid. This can be performed at any time. Product prices can be corrected or changed by WILLIAMS AMSTERDAM over time.

Orders placed under the name of another person without their permission will be reported to the authorities.

 

ORDER CONFIRMATION

When placing an order, make sure to provide the correct email address. By doing so you enable WILLIAMS AMSTERDAM to email you an electronic order confirmation and invoice. In order to facilitate any future contact with customer service, we recommend to save this email confirmation. In case of invoicing options, two confirmation mails will be sent: an order confirmation and a payment confirmation. It is recommended to keep both confirmation emails.

Important: Your electronic order confirmation and receipt serve as a guarantee of proof of purchase.

 

PAYMENTS

Generally, WILLIAMS AMSTERDAM enables payment by iDeal, accepting Maestro, MasterCard, Visa and PayPal as well as invoicing options. The privacy of customers is of paramount importance at WILLIAMS AMSTERDAM: we do not store any credit card numbers.

 

PAYMENT VIA IDEAL AND BY CARD 

If you choose to pay by card, this will be handled electronically by Adyen. WILLIAMS AMSTERDAM thereby ensures secure encryption under strict banking standards. As your card details are sent directly to your bank, they cannot be accessed by any other party. WILLIAMS AMSTERDAM does not charge extra for card payments. Starting conditions will apply as soon as the card transaction is completed. In case WILLIAMS AMSTERDAM has not received your payment, your order will automatically be canceled.

 

INVOICING OPTIONS 

The invoicing options of WILLIAMS AMSTERDAM can be used to pay for your order after placing an order. This is done by bank transfer to …… within two weeks. You will receive an order confirmation email as soon as you have placed your order. Another confirmation will be sent once the payment is completed. Your order will only be processed once payment has been received by WILLIAMS AMSTERDAM. Failure to receive or late receipt of the amount due will result in the automatic cancellation of your order.

 

GIFT CARDS

To use a WILLIAMS AMSTERDAM gift card, the ‘gift card’ payment option should be selected while making the order. The gift card can be used by entering the gift code before checkout. WILLIAMS AMSTERDAM does not honour requests to add gift cards after a purchase has been made.

 

RETENTION OF TITLE

The ordered and delivered products remain the property of WILLIAMS AMSTERDAM, until the full payment has been completed.

 

TAXES

All product prices at the www.williamsamsterdam.com website include the statutory tax rate. This means that you automatically pay VAT for your order. WILLIAMS AMSTERDAM is a Dutch company which is located in The Netherlands. WILLIAMS AMSTERDAM is not responsible for any additional VAT that has to be paid for your shipment to arrive in any destinated country.

 

WARRANTY

A warranty period of 1 year applies to every product purchased from the WILLIAMS AMSTERDAM website. This 12-month warranty starts from the date of purchase and concerns the movement of the watch. The warranty covers any manufacturing defects on the watch itself.

Other parts than the above will not be covered by this warranty. The warranty also does not apply to water damage and traces of normal use. WILLIAMS AMSTERDAM does not compensate for damage caused by the watch being dropped or hit by something.

To have replacement covered under this warranty performed, send an email with the subject ‘reclaim of purchase’ to info@williamsamsterdam.com, explaining your case. Make sure to include your name, address and order number in this email. Through email contact, further details of eventual return shipment will be discussed. In the case that WILLIAMS AMSTERDAM is unable to find any defects covered by the warranty, they will return the product to the customer. Note that dials, cases, watchbands, crystals and other parts may be replaced with substitutes in case the originals are not available. This will always be in consultation with the customer.

In some cases, even during warranty terms, repairs are charged. This applies to the following cases:

  • Esthetical changed caused by normal wear and tear and aging (minor scratches, colour change of wrist band, etc.);
  • Battery placement;
  • In case of failure or damage caused by …
    • … improper use or carelessness (crushing, dents, broken crystal, etc.);
    • … modification or unjustifiable repair;
    • … fire, water or a natural disaster;
  • In case the warranty …
    • … is not submitted with the return;
    • … contains rewritten information or edits;
    • … does not indicate purchase date;

In case an item is damaged during transport, the customer is expected to contact WILLIAMS AMSTERDAM within 30 days for information about compensation.

The 12-month warranty warrants that customers can receive free replacement within the specified term. This warranty of WILLIAMS AMSTERDAM shall not restrict any lawful customer rights.

 

DELIVERY

Williams Amsterdam currently offers delivery options throughout the whole European Union. Those deliveries are enabled via cooperation with your local postal services and their partners. The expected delivery time differs per location, and is indicated on the checkout screen of the order. Since the delivery time is only an indication, it cannot be guaranteed. Delivery can sometimes take longer, for example in case of public holidays.

In case the delivery period has been exceeded, this does in no circumstance entitle the customer to claim compensation without cancelling their order. In case the delivery is delayed in such a way that you no longer wish to receive your order, the customer is responsible for cancellation.

 

CANCELLATION

All customers that have purchased items from the WILLIAMS AMSTERDAM website retain the right for order cancellation within 30 day from receiving the goods. The cancellation right can be granted by contacting WILLIAMS AMSTERDAM via email, providing the order number and personal details. Cancellation requests will only be accepted in case the goods are packed, unused and in the same condition as when they were received. The cancellation will only be valid after the customer has confirmed with WILLIAMS AMSTERDAM by email.

You, as the customer, remain responsible for transportation risks that come along with returning goods to WILLIAMS AMSTERDAM. If the order was already shipped to the customer, the customer is obliged to receive and accept the order before cancellation can be accepted.

In the unlikely event that an ordered product is no longer available, WILLIAMS AMSTERDAM also has the right to cancel a purchase. The customer will be notified instantly after discovery. If applicable, WILLIAMS AMSTERDAM will inform the customer about possible replacements or equivalent products.

 

RETURNS 

Orders may rightfully be returned within 30 days after the product is received, as long as the product and its original packaging can be returned in the same condition as received. The return shipment information can be gathered via email contact (info@williamsamsterdam.com).

In case the return shipment is made due to defects that fall within the warranty, WILLIAMS AMSTERDAM is responsible for the return shipping costs. In case of exchange, the items must be unused, in original packaging and with all labels and protective stickers intact in order to receive a full refund.

 

COMPLAINTS TERMS

Customers are expected to carefully check their received orders to verify that the correct and undamaged products have been delivered. Visible or hidden transport-related damage must be reported as soon as possible to the carrier.

In case your received item does not match your order, or in case you have received an item that is damaged, WILLIAMS AMSTERDAM should be contacted within 30 days from receiving the shipment. This can be done by contacting our customer service via info@williamsamsterdam.com, mentioning your order number and reason for the complaint.

In all types of returns to WILLIAMS AMSTERDAM, whether they concern damaged products or not, it is extremely important to handle the items with care. The product should be packaged in such a way that it cannot be damaged during transit. Note that, in case the returned goods have no errors or faults, the product will be sent back to the customer.

Defective goods will, if possible, be replaced with goods of the same model. In case the returned item may be discontinued, WILLIAMS AMSTERDAM will provide a full refund.

 

LIABILITY

WILLIAMS AMSTERDAM can in no circumstance be held accountable for errors in connection to delivery related to for example, delivery delays, data loss, downtime, incompatibility, additional work or other economic harm.

 

FORCE MAJEURE

WILLIAMS AMSTERDAM bears no responsibility for damage or other inconveniences that hinder the execution of the contract, in the event of force majeure. This applies to cases in which circumstances arise that fall outside WILLIAMS AMSTERDAM’s sphere of influence.

Examples of such situations, are:

  • Government interventions, prohibitions and restrictions;
  • Poor transport or weather conditions;
  • Natural disasters (fire, flood, etc.);
  • Labor disturbance;
  • Wars of consequences thereof;
  • Sabotage or other criminal activities;
  • Lack of delivery from suppliers.

 

PERSONAL INFORMATION

WILLIAMS AMSTERDAM has to store some of your personal data to fulfil your order. All personal data is treated confidentially. May you believe your data is wrong or you want it to be changed or removed, then be aware that you have the right to request access to your data at any time.

PRODUCT INFORMATION

Although WILLIAMS AMSTERDAM tries to ensure that all content, such as the product information, is accurate, errors may occur. The available product images and information texts serve the purpose to reflect the products as much as possible. However, we cannot guarantee an accurate online reflection of the true appearance of all items. All product images should be interpreted as an illustration, of which the visual representation may differ depending on the colour settings on your computer.

WILLIAMS AMSTERDAM has the right to change the product assortment, adjust related information and prices and add additional costs without notice.

 

INTELLECTUAL PROPERTY RIGHTS

WILLIAMS AMSTERDAM or its subsidiaries or licensors own all intellectual property rights on the website and in the published materials, such as trademarks and copyrights. Using, copying or storing content from the website in whole or in part is prohibited for commercial use without the permission of WILLIAMS AMSTERDAM.

 

USER CONTENT 

The website of WILLIAMS AMSTERDAM might include content that is user-generated (such as social media applications). WILLIAMS AMSTERDAM does not take legal responsibility for violation of any right in such content. In case you are suspicious of any violation or are offended by such content, please contact us through phone or email.

 

FRAUD 

Any case of fraud will be reported to the authorities. WILLIAMS AMSTERDAM reserves the right to cancel any order by which any suspicion is raised.

 

TERMINATION 

Your account and/or use of the website may be terminated by WILLIAMS AMSTERDAM at its sole discretion, without prior notice. This right may be enforced in the event of, for example, suspected violation of these terms and conditions.

 

GOVERNING LAW AND JURISDICTION

The general terms and conditions of WILLIAMS AMSTERDAM as well as your use of the www.williamsamsterdam.com website are governed by Dutch law. Dutch law courts have, to the extent permitted by law, the exclusive jurisdiction of any dispute arising from these terms and conditions and your use of the website. The right of WILLIAMS AMSTERDAM is hereby observed, whereby they may prosecute a user in his / her place of residence.

This since WILLIAMS AMSTERDAM can make adjustments to the general terms and conditions over time.
